Celebrating the U.S. Constitution

It stands for life, liberty and the pursuit of happiness. Join the OU community in honoring the document that makes this country great on Constitution Day, Sept. 17. Expert Justin J. Wert, assistant professor in the Department of Political Science, shares his views on "Our Constitution."

As we celebrate the first Constitution Day at the University of Oklahoma, we are also witnessing the politics surrounding the nomination of D.C. Circuit Court Justice John Roberts to Chief Justice of the Supreme Court. President Bush nominated John Roberts to the bench on September 5 to replace William Rehnquist according to the power granted to him in Art. II, Sec.2 of the “Constitution.” With advice and consent of the Senate (Art. II, Sec.2), he most probably will be nominated to that position for life (Art. III, Sec.1). Thus, Roberts, along with his other eight colleagues, will decide monumentally important cases of Constitutional law almost immediately: abortion restrictions; cloning and bio-ethics questions; internet privacy and use; and the scope of presidential war power, to name a salient few.

But as we are bombarded with the politics of appointments I would assert that we have the unique opportunity today to step back and ponder a seemingly quaint, but extremely important, proposition: Just what is this “Constitution” that the “court” is interpreting? And is it really “ours”?
